By accessing or using the services of Pine to Pixel, LLC (“Pine to Pixel,” “we,” “us,” or “our”), you (“Client,” “you,” or “your”) agree to be bound by these Terms and Conditions. Please read them carefully.

2. Services
Pine to Pixel provides:

Photography
-
Video editing
-
AI content creation
-
Social media consulting
Digital Deliverables: Delivered via email or secure file-sharing services (e.g., Dropbox). No physical products are sold.
Bookings & Payments: All bookings and payments are handled off-site; our website is for informational purposes only.

Service Flexibility: Pine to Pixel reserves the right, at its sole discretion, to expand, modify, or discontinue any of its services at any time without prior notice.
3. Payments, Refunds & Cancellations
3.1 Payment Terms

Payment Methods: Secure bank transfers (ACH) and all major credit/debit cards via invoice.

Preferred Method: ACH transfer (no extra fees).
-
Payment Due: Within 30 days of the invoice date.
3.2 Client Cancellations
-
>14 Days Before Shoot: Full refund minus 5% administrative fee.
-
7–14 Days Before Shoot: One free reschedule or 50% refund.
-
<7 Days Before Shoot: Non-refundable; one reschedule allowed with 25% rescheduling fee.
3.3 Rescheduling
-
One complimentary reschedule allowed within 90 days if requested ≥7 days in advance.
-
Additional or short-notice reschedules incur a 25% fee.
3.4 Weather, Safety, & Unforeseen Conditions
-
Pine to Pixel may reschedule due to unsafe conditions (e.g., heavy rain, high winds, poor visibility).

If rescheduling within 60 days is not possible:
-
Credit for full booking value (valid 12 months) or
-
Partial refund of 70% of total fee (30% retained for pre-production/travel costs).

3.5 Cancellations by Pine to Pixel
-
In rare events (illness, emergency, equipment failure):
-
Priority reschedule at no charge or
-
Full refund of payments.
-

Pine to Pixel is not liable for indirect or consequential losses from cancellations.
3.6 Technical or Delivery Issues
-
If delivery is affected by technical issues not caused by the client:
-
Partial or full refund, or
-
Re-shoot at no additional cost (subject to availability).

Once media is delivered, all sales are final.
3.7 Force Majeure
-
Neither party is liable for delays or cancellations due to events beyond reasonable control (e.g., natural disasters, government actions, power outages). Both parties will work in good faith to reschedule.
3.8 Agreement

By booking a service, you acknowledge that you have read, understood, and agree to this Payment, Refund, and Rescheduling Policy.
4. Intellectual Property
4.1 Copyright Ownership

All media produced remains the sole property of Pine to Pixel unless stated otherwise in writing.
4.2 Client License
-
Upon full payment, the client receives a non-exclusive, non-transferable, perpetual license for marketing, advertising, promotion, and internal business use.
-
License does not permit resale, sublicensing, or third-party distribution without written consent.
4.3 Portfolio Use
-
Pine to Pixel may display media for promotional purposes (website galleries, social media, printed portfolios).
-
Media use will be professional and respectful; credit will be given when applicable.
4.4 Sensitive Content

Clients may request in writing to exclude sensitive media from public use. Pine to Pixel will honor requests received prior to release.
4.5 Third-Party Usage
-
Third parties must obtain permission directly from Pine to Pixel unless otherwise agreed in writing.
5. Privacy & Data Collection

6. Limitation of Liability
To the fullest extent permitted by law:

Pine to Pixel is not liable for direct, indirect, incidental, special, consequential, or punitive damages.

Not liable for losses from: weather, project delays, equipment malfunction, third-party actions, client-provided materials, or force majeure events.

Maximum Liability: Total liability capped at the amount paid for the specific project.
-
Clients acknowledge inherent risks and assume responsibility for decisions made based on content produced.
7. Governing Law & Jurisdiction

All disputes will be governed by and interpreted under the laws of Idaho.
-
Any legal action must be brought in courts located within Idaho.
